you working for?” photo contest (the "Contest") starts on December 15,
2012 at 12 AM CST and ends on January 31, 2013 at 11:59 PM CST (“Contest
Period").
ELIGIBILITY:
Contest is open to legal residents of the 50 United States. Employees
of Greater Dubuque Development ("Sponsor") and their respective parents,
subsidiaries, affiliates, promotion and advertising agencies, and
members of their immediate family (spouse and parent, children and
siblings and their respective spouses, regardless of where they reside)
and persons living in the same household, whether or not related, of
such employees, are not eligible to enter or win.
HOW
TO ENTER: During the Contest Period, submit a photograph (the "photo")
that explains what you are working for. To enter the Contest, (a) all
entry photographs must be posted to this website. Entry must be in a
.jpg format. All Entries must be received by January 31, 2013 at 11:59
PM CST to be considered eligible. Limit one (1) Entry per person and per
email address. Entries received from any person or email address in
excess of the limitation will be void. Without limitation, the Sponsor
is not responsible for late, lost, misdirected, delayed, incomplete or
incompatible Entries. All Entries become the sole property of the
Sponsor and will not be returned. Entries (photographs) may be utilized
in any and all of its publications, including websites, social media
(ie. Facebook, Twitter, Linkedin). By submitting this photograph,
Greater Dubuque Development has permission to edit, alter, copy,
exhibit, publish or distribute this photo for purposes of publicizing
the Greater Dubuque Development’s programs or for any other lawful
purpose. In addition, I waive the right to inspect or approve the
finished product, including written or electronic copy, wherein my
likeness appears. Additionally, I waive any right to royalties or other
compensation arising or related to the use of the photograph.
BY
SUBMITTING AN ENTRY, THE ENTRANT AGREES THAT THE ENTRY COMPLIES WITH
ALL CONDITIONS STATED IN THESE OFFICIAL RULES. THE SPONSOR WILL BEAR NO
LEGAL LIABILITY, EXPRESSED OR IMPLIED, REGARDING THE USE OF THE ENTRY BY
THE SPONSOR AND THE SPONSOR SHALL BE HELD HARMLESS BY AN ENTRANT IN THE
EVENT IT IS SUBSEQUENTLY DISCOVERED THAT THE ENTRANT HAS DEPARTED FROM
OR NOT FULLY COMPLIED WITH ANY OF THE OFFICIAL RULES. REQUIREMENTS OF
ENTRIES:
Your entry shall NOT contain, as determined by the Sponsor, in its sole discretion, any content that:
- is
unnecessarily violent or derogatory of any gender, sexual orientation,
disability, ethnicity, race, gender, religion, profession or age group;
profane or pornographic;
- promotes
alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of
the foregoing); promotes any activities that may appear unsafe or
dangerous;
- is obscene or offensive; endorses any form of hate or hate group; appears to duplicate any other submitted Entries;
- defames, misrepresents or contains disparaging remarks about other people, companies, or organizations;
- contains
trademarks, logos, or trade dress (such as distinctive packaging or
building exteriors/interiors) owned by others, without permission (for
example, any clothing worn by persons appearing in your photograph must
not contain any visible logos, trademarks, or other third party
materials, unless the necessary permissions/licenses have been obtained
or such materials blurred out); contains any personal identification,
such as license plate numbers, personal names, e-mail addresses or
street addresses;
- contains
copyrighted or copyright protected materials where the copyright is
owned by others (including photographs, sculptures, paintings, and other
works of art or images published on or in websites, television, movies,
music, or other media), without express written permission;
- contains look-alikes of celebrities or other public or private figures, living or dead;
- communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate;
- contains
any other content that is or could be considered inappropriate,
unsuitable, or offensive, all as determined by the Sponsor in its sole
discretion; and/or
- violates any law.
By
submitting an Entry, entrant warrants and represents that he/she and
any persons appearing or who are identifiable in the Entry consent to
the submission and use of the Entry in the Contest and to its use as
otherwise set forth herein.
Each
entrant agrees to reimburse Sponsor and other Released Parties (as
defined below) in full in respect of any expense, cost, or liability
incurred by Sponsor or any other Released Party as a result of any
claims of infringement or other breach of intellectual property or other
rights by any third party resulting from Sponsor or other Released
Party's use of any element of the entrant's Entry as authorized by these
Official Rules.
For
all Entries: By submitting your Entry, you agree that your Entry
conforms to these Official Rules and that Sponsor, in its sole
discretion, may disqualify your Entry for any reason, including if it
determines, in its sole discretion, that your Entry fails to conform to
these Official Rules in any way or otherwise contains unacceptable
content as determined by Sponsor, in its sole discretion.
By
submitting an Entry, entrant hereby grants permission for the Entry to
be utilized on materials. Entrant agrees that Released Parties (as
defined below) are not responsible for any unauthorized use of Entries
by third parties. Released Parties do not guarantee the posting of any
Entry. Prior to being posted online, the Sponsor reserves the right, in
its sole discretion, to edit or modify any Entry, or to request an
entrant to modify or edit his or her Entry, in order, to ensure that the
Entry complies with these Official Rules, or for any other reason.
Odds of winning depend on the number of eligible entries received.
Automated voting of any kind is not allowed. Detection of said automated voting will lead to votes being voided.
Only
one registered account per voter. If multiple accounts are detected for
a single voter, they will be disabled and votes disqualified.
WINNER
NOTIFICATION: Winners will be notified by email. If a winner is
unreachable after seven (7) days, or if that winner is unavailable for
prize fulfillment, an alternate winner will be selected. If Telegraph
Herald cannot find an eligible winner for the prize, that prize will not
be awarded.
PRIZES:
The Grand Prize winner will receive a $300 Hy-Vee gift card, second
place $150 gift card, and third place $100 Hy-Vee gift card.Winners may
not substitute, assign or transfer prize, but Sponsor reserves the
right, at its sole discretion, to substitute prize (or portion thereof)
with one of comparable or greater value. Any additional prize details
are at Sponsor's sole discretion. Without limitation, the Sponsor is not
responsible for the distribution of any prize between any persons who
may have participated in making the Entry.
GENERAL
CONDITIONS: By participating, each entrant agrees: (a) to abide by
these Official Rules and decisions of Sponsor and judges, which shall be
final and binding in all respects relating to this Contest without
right of appeal, including, without limitation, any decisions regarding
the eligibility/disqualification of Entries; (b) to release, discharge
and hold harmless Sponsor, and its parents, affiliates, subsidiaries,
and advertising and promotion agencies, and the respective officers,
directors, shareholders, employees, agents and representatives of the
forgoing (collectively, "Released Parties") from any and all injuries,
liability, losses and damages of any kind to persons, including death,
or property resulting, in whole or in part, directly or indirectly, from
entrant's participation in the Contest or any Contest-related activity
or the acceptance, possession, use or misuse of any awarded prize and
(c) to the use of his/her name, photograph, image and/or likeness for
programming, advertising, publicity and promotional purposes in any and
all media, now or hereafter known, worldwide and on the Internet, and in
perpetuity by Sponsor and its designees, without compensation (unless
prohibited by law) or additional consents from entrant or any third
party and without prior notice, approval or inspection, and to execute
specific consent to such use if asked to do so. By participating,
entrant also agrees not to release any publicity or other materials on
their own or through someone else regarding their participation in the
Contest without the prior written consent of the Sponsor, which it may
withhold in its sole discretion.
OWNERSHIP/USE
OF ENTRIES: Entrants will retain ownership of their Entries. However,
by entering this Contest, entrants grant Sponsor and all other Released
Parties a royalty-free license to edit, modify, cut, rearrange, add to,
delete from, copy, reproduce, translate, dub, adapt, publish,
distribute, exploit, and use Entries and the content of and elements
embodied in the Entries, including, without limitation, the names and
likenesses of any persons or locations embodied therein, in any and all
media now known or hereafter devised, worldwide, in perpetuity without
compensation, permission or notification to entrant or any third party.
By entering this Contest, entrants represent and warrant that the above
described license to the Sponsor does not violate any third party rights
or agreements. Each entrant hereby waives any claim that the entrant
may otherwise now or hereafter have in any jurisdiction based on "moral
rights" or unfair competition law in respect of Sponsor or any other
Released Party's use of the Entry as authorized by these Official Rules.
Entrants also agree not to instigate, support, maintain, or authorize
any action, claim or lawsuit against Sponsor and any other Released
Party on grounds that any use of the Entry as authorized by these
Official Rules infringes or violates any rights of any entrants.
ENTRANT
DATA: All personal information collected will be used in accordance
with the Privacy Policy, unless the entrant otherwise agrees.
MISCELLANEOUS:
UPICKEM, Telegraph Herald, and Greater Dubuque Development are not
responsible for Internet crashes or slowdowns caused by network
congestion, viruses, sabotage, satellite failures, phone line failures,
electrical outages, natural disasters or acts of man or God.
This
contest is not intended for gambling. If it is determined that a
contestant is using the contest for gambling purposes, they will be
disqualified and reported to authorities.
This contest is officially sponsored by Telegraph Herald and Greater Dubuque Development Corporation.
Released
Parties are not responsible for lost, late, incomplete, damaged,
inaccurate, illegible, stolen, delayed, misdirected, undelivered, or
garbled Entries; or for lost, interrupted or unavailable network,
server, Internet Service Provider (ISP), website, or other connections,
availability or accessibility or miscommunications or failed computer,
satellite, telephone or cable transmissions, lines, or technical failure
or jumbled, scrambled, delayed, or misdirected transmissions or
computer hardware or software malfunctions, failures or difficulties, or
other errors or difficulties of any kind whether human, mechanical,
electronic, computer, network, typographical, printing or otherwise
relating to or in connection with the Contest, including, without
limitation, errors or difficulties which may occur in connection with
the administration of the Contest, the tabulation of votes, the
announcement of the prizes, or in any Contest-related materials.
Released Parties are also not responsible for any incorrect or
inaccurate information, whether caused by site users, tampering,
hacking, or by any equipment or programming associated with or utilized
in the Contest. Released Parties are not responsible for injury or
damage to any person's computer related to or resulting from
participating in this Contest or downloading materials from or use of
the website. Persons who tamper with or abuse any aspect of the Contest
or website, who act in an unsportsmanlike or disruptive manner or who
are in violation of these Official Rules, as solely determined by
Sponsor, will be disqualified and all associated Entries will be void.
Should any portion of the Contest be, in Sponsor's sole opinion,
compromised by virus, worms, bugs, non-authorized human intervention or
other causes which, in the sole opinion of the Sponsor, corrupt or
impair the administration, security, fairness or proper play, or
submission of Entries, Sponsor reserves the right at its sole discretion
to suspend, modify or terminate the Contest and, if terminated, at its
discretion, select the potential winners from all eligible, non-suspect
Entries received prior to action taken using the judging procedure
outlined above. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE
OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION
OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR
RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING
ATTORNEYS' FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE
LAW, INCLUDING CRIMINAL PROSECUTION.
In
the event of a dispute regarding who submitted an Entry, entries will
be deemed to have been submitted by the authorized account holder of the
email address submitted at the time of entry, "Authorized account
holder" is defined as the person who is assigned an email address by an
internet provider, online service provider, or other organization (e.g.
business, educational institute, etc.) that is responsible for assigning
email addresses for the domain associated with the submitted email
address. A selected entrant may be required to provide proof that he/she
is the authorized account holder of the email address associated with
the selected entry. The sole determinant of the time for the purposes of
a valid online entry in this contest will be the contest server
machines(s).
The
Sponsor reserves the right to cancel or suspend this Contest or to
amend these Official Rules without prior notice or obligation, in the
event of any accident, printing, administrative, or other error of any
kind.
